Terms of Service
These marketplace rules govern every listing and every purchase on MintedUK, operated by MintedUK LTD (Company No. 17339202, registered office: Suite A, 82 James Carter Road, Mildenhall, IP28 7DE, United Kingdom). Version 2026-08-30 — effective 30 August 2026.
1. Who we are and the nature of our service
MintedUK LTD (Company No. 17339202, registered office: Suite A, 82 James Carter Road, Mildenhall, IP28 7DE, United Kingdom) ("MintedUK", "we", "us") operates an online marketplace (the "Platform") enabling Casual, Casual Business, Artisan, Pro and Charity sellers ("Sellers") to advertise goods to United Kingdom purchasers ("Buyers"). We provide technology, payment facilitation and dispute handling only.
Each contract of sale is formed exclusively between Buyer and Seller. MintedUK is not a party to, nor merchant of record in respect of, any contract of sale concluded through the Platform, takes no title to goods, and is not the agent of either party for concluding that contract. The Seller is at all times merchant of record and is solely responsible for the goods, their description, quality, safety, packaging, dispatch and after-sales obligations. Nothing in these Terms creates a partnership, joint venture, agency, employment or fiduciary relationship.
Exclusion of liability. To the fullest extent permitted by law, MintedUK is not liable to any Buyer, Seller or third party for any loss, damage, cost or expense (direct, indirect or consequential, in contract, tort (including negligence), breach of statutory duty or otherwise) arising from (i) any defect, non-conformity, unsafe condition, mis-description or infringement in goods listed or supplied by a Seller; (ii) any breach or repudiation by a Buyer or Seller of a contract of sale; or (iii) any act, omission, insolvency or dishonesty of a Buyer or Seller. Nothing excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
Contracts (Rights of Third Parties) Act 1999. A non-party has no right under that Act to enforce these Terms, and no Buyer acquires a direct right of action against MintedUK in respect of a contract of sale with a Seller. This does not affect rights available apart from that Act, including non-excludable statutory rights against the Seller as merchant of record.
2. Seller obligations and indemnity
- Each Seller warrants that it has full right, title and authority to sell the goods listed, that they are its unencumbered property (or that it is authorised to sell them), and that their sale will not infringe the intellectual property, contractual or other rights of any third party.
- Artisan and Pro Sellers accept sole legal and financial responsibility for product safety and compliance under the Consumer Protection Act 1987, the General Product Safety Regulations 2005, the Consumer Rights Act 2015 and all other applicable UK legislation. Product and public liability insurance is not a condition of trading, but is strongly recommended — particularly for cosmetics, toys, candles and food.
- Casual Sellers may list personal items in any condition, including new with tags, and may list individual items from bulk or trade stock provided each is listed separately. Handmade goods may be listed on the Casual Business tier as well as Artisan. Bulk-listing tools, multi-quantity inventory and shop sections are optional Pro/Artisan upgrades. Sellers listing business or trade stock must comply with all trader obligations under UK consumer law, including the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. The same rules apply to Charity Sellers listing donated goods.
- All listings must accurately describe condition, brand, size, composition and material. Misleading, inaccurate or unlawful listings may be removed and may result in suspension or termination.
- Listing allowances and the Casual Business listing fee. If you sell on a Casual account with business selling switched on (a Casual Business account), you may publish 300 listings free of charge in any rolling 30-day period. This is an allowance, not a cap: you may continue publishing beyond it, and each further listing accrues a fee of 20p. Accrued fees are settled automatically out of your next payout. If your unsettled balance reaches £20 you cannot publish further chargeable listings until it clears, and any balance still unsettled after 90 days is written off.
- Who this fee does not apply to. Private Casual Sellers are neither charged this fee nor capped. Artisan, Pro and Charity accounts are uncapped and never carry it. We may adjust allowances to protect platform performance or prevent abuse and will notify you in your dashboard.
- Pausing your shop. Sellers of any tier may temporarily close their shop; while closed, listings are hidden and cannot be purchased, but existing orders remain subject to Sections 8 to 10.
- Indemnity. Each Seller shall indemnify and hold harmless MintedUK, its officers, employees and agents against all claims, proceedings, losses, damages, fines, penalties, costs and expenses (including reasonable legal fees on a full indemnity basis) arising from (a) any goods listed or supplied by the Seller; (b) any breach by the Seller of these Terms or applicable law; or (c) any claim by a Buyer or third party in respect of the Seller's goods or conduct.
3. Prohibited items, automated checks and appeals
Prohibited categories include counterfeits and replicas (fake, replica, AAA, 1:1 or "inspired by" branded goods); age-restricted items (vapes, tobacco, alcohol, weapons, adult toys, gambling products, fireworks); and health hazards and regulated goods (medicines, illegal drugs, used cosmetics, bodily-fluid items, hazardous chemicals, uncertified electricals). The full list is on our Prohibited items page, which forms part of these Terms. MintedUK may remove prohibited listings without notice and at its sole discretion, and suspend or terminate the responsible account, without being required to give reasons and without liability.
- Pre-publication checks. We run automated checks on title, description, photos and price for prohibited items, counterfeit indicators, safety and compliance issues and duplicates. A listing that fails is blocked before publication and never appears in the public feed while the block stands.
- Every block is appealable. Blocks and their reasons appear in Dashboard → Blocked listings, where you may appeal and attach evidence such as receipts or authentication paperwork. Appeals are reviewed by a person, not by the system that raised the block; if a block is overturned the listing may be published once without re-running the same check.
- Automated checks can be wrong. Genuine branded items are welcome. A block is not an accusation and appealing will not count against your account.
- Repeat breaches. Deliberate or repeated attempts to publish prohibited items, including evading checks by disguising words or images, may lead to restriction, suspension or termination.
- Importing listings from other marketplaces. The optional importer creates editable drafts from the public pages of a shop you control. You must own or be authorised to manage that shop and verify ownership before an import runs; imported drafts are never published automatically and you remain responsible for their accuracy, pricing and compliance; you must comply with the source site's terms; and import records are deleted after 30 days. Our importer policy forms part of these Terms and we may decline or stop any import.
4. Keeping sales on-platform and fee enforcement
All listings, communications, negotiations and payments must take place exclusively on the Platform. Listings and messages must not contain external links or website addresses (other than minteduk.com); phone numbers, email addresses, social handles or invitations to move to WhatsApp, Telegram, Instagram, Snapchat or any other off-platform channel; off-platform payment methods such as PayPal Friends & Family, bank transfer, Revolut, Monzo, Cash App, Venmo or Zelle; or language encouraging buyers to complete a sale off-site or to avoid fees.
Fee circumvention. Any attempt to divert a transaction off-platform, avoid MintedUK fees, or complete payment outside the Platform is a material breach. We may (i) charge the Seller the full commission and platform operating fee that would have applied; (ii) recover all associated costs, including legal costs; and (iii) suspend or terminate the Seller's account and any related accounts.
Zero liability off-platform. MintedUK has no liability, in contract, tort (including negligence), breach of statutory duty or otherwise, for any loss, fraud, scam, misrepresentation, non-delivery, defective goods or other detriment arising from any transaction, communication or payment conducted outside the Platform. Users who transact off-platform do so entirely at their own risk.
5. High-value listings (£1,000+)
Listings priced above £1,000 may be held for a short manual review (usually resolved within one working day, at no charge and with no effect on tier or rating) before appearing on the public feed. Such review is administrative only — for fraud detection, policy compliance and user safety — and is not an endorsement, authentication, validation, warranty or guarantee of the item, its genuineness, condition, value or the accuracy of the listing.
Seller liability for authenticity. The Seller remains solely liable for the authenticity, condition, description, quality, provenance, safety and legal compliance of every item, whether or not priced above £1,000 and whether or not reviewed by MintedUK. MintedUK makes no representation and assumes no liability in relation to the authenticity of any goods.
6. Purchase protection and statutory rights
Platform Operating Fee Release Window. Buyer payment is held by the payment processor and is not released to the Seller until the Buyer confirms receipt and satisfactory inspection, or the contractual Platform Operating Fee Release Window (Section 9) expires. Funds are held in a Stripe-managed account operated by Stripe Payments UK Limited (an FCA-authorised e-money institution) — MintedUK does not hold, safeguard or take title to Buyer funds at any point. This is a contractual arrangement, not a trust, deposit-taking or payment service on MintedUK's part, and does not affect statutory rights.
Business sellers: Consumer Contracts Regulations 2013. The 14-day cooling-off right applies only to contracts with business sellers. On MintedUK the Pro, Artisan and Casual Business (verified small business) tiers are business sellers, and we enforce a 14-day return window on their listings from the day the Buyer receives the item, unless the item is exempt.
Who pays return postage. On a cooling-off return the cost falls on the party disclosed on the listing. A business seller may require the Buyer to pay return postage only where that was clearly displayed on the listing before purchase; where the listing is silent the Seller bears the reasonable cost, which is the statutory default. The Buyer never pays return postage where the item is faulty, damaged, counterfeit or materially not as described.
Private sellers: Consumer Rights Act 2015. Casual sellers act as private individuals and their sales carry no cooling-off right, but goods must still be as described, of satisfactory quality and fit for purpose, and the Buyer may be entitled to a remedy if an item is faulty, not as described, or never arrives.
- Consumer Rights Act 2015 — applies to all sales; a buyer may be entitled to refund, repair or replacement depending on timing and fault. This applies to preloved items unless every flaw was clearly disclosed before purchase.
- Consumer Protection from Unfair Trading Regulations 2008 — sellers must not mislead buyers about brand, condition, origin or value; misrepresenting listings will be removed.
- Consumer Protection Act 1987 — goods must be safe for normal use. Unsafe, recalled, unregulated or counterfeit items are prohibited.
- Payment processing. MintedUK is not a payment service provider, e-money institution, authorised payment institution or deposit-taker. All card payments, pre-authorisations, refunds and payouts are performed by Stripe, Inc. and its affiliates under Stripe's own terms, to which each user agrees as between that user and Stripe.
- Chargeback and bank rights. A Buyer may have chargeback or other rights through its bank or card issuer under the Payment Services Regulations 2017. These are independent of the Platform's contractual arrangements and do not replace statutory remedies against the Seller.
7. Binding offers and contract formation
When a Buyer uses Make an Offer, a payment pre-authorisation is taken via Stripe Connect. By submitting an offer the Buyer irrevocably waives any right to revoke it for 24 hours, during which the Seller may accept. A binding purchase contract is formed the moment the Seller clicks Accept Offer, and the Buyer authorises MintedUK to instruct Stripe to capture the pre-authorised funds and start the shipping label workflow. Accepted offers cannot be unilaterally withdrawn. All capture, fund holding, refunds and payouts are performed by Stripe; MintedUK does not hold funds as agent or trustee.
8. Fast-Track Lifecycle: transit, collection & fees
All users agree to the MintedUK Fast-Track Lifecycle. Time limits are subject to agreed mutual extensions and courier-data buffers.
- Valid days (Sundays excluded). Every 3-day window below is counted in valid days; a Sunday inside a window is skipped and a deadline never falls on a Sunday. Countdown timers already reflect this.
- Seller dispatch — 3 valid days. Sellers must deposit parcels at an integrated courier drop-off within 3 valid days of an order. Orders not dispatched may be automatically cancelled and refunded in full, save that where carrier webhooks or tracking indicate dispatch or awaiting collection, MintedUK may suspend automated cancellation to reflect the actual logistics position.
- Buyer collection — 3 valid days. Parcels delivered to a parcel shop or pickup point must be collected within 3 valid days of the delivery notification. Missing the window does not itself cancel the order or trigger a fee; the parcel remains at the collection point.
- Negative collection flag. Non-collection within the window without a prior mutually agreed extension records a negative collection flag on the Buyer's profile, with both parties notified. The order stays open pending collection or carrier return. Repeated flags may result in restricted checkout access or account review.
- Carrier return and pre-disclosed administration fee. If the parcel is ultimately returned to the Seller by the carrier after non-collection, the Buyer is in breach of the purchase contract. The fee schedule shown on every listing and at checkout discloses a fixed £2.99 Failed Collection Administration Fee, charged to cover administrative and re-packaging losses arising from that breach. It is disclosed pre-contract in accordance with the Digital Markets, Competition and Consumers Act 2024. MintedUK will then cancel the order and refund the Buyer less that fee. The Seller is not charged.
- Collection health. Parcel-shop and locker deliveries contribute to a public Collection health score generated by automated processing of collection timing and flags. This is automated profiling under UK data protection law and is handled in accordance with the MintedUK Privacy Policy.
- Mutual time extensions. Buyer and Seller may agree to extend the dispatch, collection or Platform Operating Fee Release Window. An extension takes effect on the other party's explicit in-platform confirmation, pausing the automated countdown and moving the deadline by the agreed amount.
Seller & buyer fee schedule
All fees are disclosed before checkout in accordance with the Digital Markets, Competition and Consumers Act 2024 (no drip pricing).
- Preloved & Charity — seller keeps 100%. Buyer pays a platform operating fee of 50p + 5% of the item price, funding held-funds safeguarding, dispute resolution, the refund guarantee, moderation and safety review. It is not a card surcharge; card payments are free to buyers as required by the Payment Services Regulations 2017 (reg. 6A).
- Artisan (handmade) — 7% + 25p on the item, deducted from the seller's payout. No buyer fees.
- Pro (commercial) — 3% + 30p on the total order (item + shipping), deducted from the seller's payout. No buyer fees. £19/month subscription.
- Delivery — MintedUK sets shipping rates via integrated carriers (sellers cannot mark up postage). The delivery price at checkout includes platform logistics handling; there is no separate parcel charge and no card surcharge, and the delivery total is always shown pre-checkout.
8a. Local collection
Sellers may offer free local collection. It is a private, seller-managed arrangement that must stay on-platform: time and place are agreed in the MintedUK order thread and payment must be completed through the Platform so the Platform Operating Fee Release Window applies.
- Arranging and timing. Either party may propose a safe, public collection point and time; the other must confirm in writing on the Platform. Collection must normally take place within 3 valid days of purchase unless a time extension is mutually agreed. An unconfirmed or repeatedly missed window counts as a missed collection for the Buyer's collection health.
- Proof of handover. The Buyer should mark the item as collected in the order screen. If the Buyer fails to do so despite evidence of handover, the Seller may request a review and MintedUK may, at its discretion and on reasonable evidence, mark the order collected and release funds.
- On-platform payment required. Cash on collection, bank transfer and other off-platform payment methods are not permitted; report any such request. Only on-platform payment engages Purchase Protection and the dispute process.
- Inspection at collection. The Buyer may inspect the item at handover; if it is materially different from the listing the Buyer should not mark it collected and should raise a dispute in the order thread. Once collected, the 12-hour Platform Operating Fee Release Window runs from the moment the Buyer marks the order collected.
- Physical safety disclaimer. MintedUK is not liable, in contract, tort (including negligence), breach of statutory duty or otherwise, for personal injury, property damage, theft, fraud, assault, accident or any other loss arising out of an in-person collection, meeting or handover, or travel to or from one. Users choosing local collection do so entirely at their own risk and are responsible for choosing a safe public location and taking appropriate precautions.
9. Platform Operating Fee Release Window
Where a parcel is collected from a parcel shop or a local collection is marked complete, the 12-hour active inspection window begins immediately. Where a parcel is delivered to a residential address, courier confirmation alone does not start it: the Buyer has 12 hours from the delivery scan to confirm receipt, and the inspection window then runs from that confirmation. If the Buyer does not respond, receipt is auto-confirmed at the 12-hour deadline and the window starts then — 24 hours in total from the delivery scan. A Buyer who cannot respond (illness, hospital admission, or a parcel that has not in fact arrived) may contact support, who may place a hold pausing both clocks while the matter is investigated.
- The 12-hour countdown only ticks during active hours, 08:00 to 22:00 UK time (Europe/London), and pauses automatically overnight, with remaining hours resuming at 08:00. An item delivered at 15:00 therefore expires at 13:00 the next day; one delivered at 23:30 does not start counting until 08:00. The order screen shows a "Timer paused until 08:00" status during a pause.
- Within the window the Buyer may raise a formal dispute through the Platform. If no dispute is raised before the 12 active hours expire, the window closes and the transaction is finalised. This inspection lock prevents wear-and-return and rental abuse and does not override statutory rights on purchases from business sellers (Section 6).
- When the Seller is paid. For private Casual Sellers, the payout is released as soon as the inspection window closes. For business sellers — Pro shops, Artisan makers and Casual Business accounts — the payout is instead released once the 14-day statutory cancellation period in Section 6 has ended, because until then the Buyer still has the right to cancel and be refunded. The period runs from delivery, not from the date of the order. Charity accounts are not business sellers for this purpose and are paid on the inspection window.
- A payout is held past either of the above while a dispute or return is open on the order, while support has placed a hold, or while the Seller's payouts are locked pending tax verification (Section 12). The order screen shows the Seller the date their funds are due to be released.
9a. Returns shipping & oversized parcels
Approved returns must travel on an official MintedUK-issued shipping label wherever our integrated carrier network can accept the parcel; self-arranged returns of standard-sized parcels do not qualify for refund release because chain of custody cannot be verified without integrated tracking.
Oversized and out-of-network parcels. Where an item exceeds carrier limits (typically over 30kg, longest side over 120cm, or bulky/restricted goods) a platform label cannot be issued and MintedUK will authorise an approved outside-courier return in writing in the order thread. The party responsible for return postage must book a tracked and insured service to the value of the order, upload tracking and proof of postage before dispatch, and retain the receipt until refund.
Transit risk. Where a Buyer uses an unapproved courier, or returns outside our written approval, the Buyer bears all risk of loss, damage or non-delivery, no refund funds are released, and any claim must be pursued with the carrier. Untracked returns do not trigger refund release. This is consistent with the Buyer's duty of reasonable care under the Consumer Contracts Regulations 2013. Responsibility for return postage on business sales is as set out in Section 6, and reasonable postage on an approved outside-courier return is reimbursed by the liable party.
9b. Lost or damaged in transit
Every order booked through the Platform ships on a tracked-and-signed service (Royal Mail, Evri, InPost, Parcelforce or DPD) whose standard carrier compensation cover is matched to item value at checkout. Checkout only offers services meeting the minimum cover for the value band: under £50, standard tracked; £50–£149.99, minimum £150 cover; £150–£499.99, minimum £500 cover; £500+, minimum £750 cover. Services below the required tier are hidden.
- Where an integrated carrier confirms a parcel is lost or the goods are damaged, the Buyer receives a full refund from held funds (item price, platform operating fee and shipping) regardless of the cover limit, and the Seller is not charged or penalised on dispatch or collection health. MintedUK lodges the carrier claim.
- Recovery from the carrier is capped at the chosen service's stated cover ceiling. Any residual loss above that ceiling sits with the platform reserve, not the Seller, provided the Seller used the platform-booked label.
- Off-platform or unapproved couriers. Where a Seller dispatches outside MintedUK, transit risk sits entirely with the Seller, any Buyer refund is recovered from the Seller's payout balance, and any carrier claim must be pursued by the Seller.
- Timelines. A parcel is treated as lost once the carrier's own lost-in-transit timeframe is reached (typically 10 working days for Royal Mail Tracked and Evri, 5 for DPD/Parcelforce, 15 for Royal Mail Special Delivery). Damage claims must be raised through the dispute flow within 48 hours of delivery with dated photographs of the packaging and item.
10. Order cancellations
A Buyer cannot unilaterally cancel an order and must submit a Cancellation Request stating a reason. Requests can only be raised before dispatch; once shipped, the Returns or Disputes flow applies.
- If the Seller approves, the order is cancelled, the Buyer is refunded in full, and both parties are blocked from leaving feedback or ratings for that transaction. This is not suppression of consumer reviews: the contract is dissolved by mutual agreement before any service is rendered, so there is no transaction to review and the review pathway is inactivated to prevent retaliatory or misleading scoring.
- If the Seller declines, they must give a written explanation (for example, that the item has already been dropped off). The order returns to its in-progress state and the explanation is shown to the Buyer on the order tracking page.
11. Multiple accounts and anti-shilling
A person may hold a maximum of two accounts, and those accounts must be on different seller tiers (for example one Casual and one Artisan). You cannot hold three or more accounts, nor two accounts on the same tier. This keeps casual preloved sales separate from commercial activity while preventing circumvention of tier limits, fees or review systems.
- Verification and linking. Both accounts must complete identity verification before they can be linked. Linking is optional and only needed to sell under a different tier. Linked accounts share an identity fingerprint and can be switched between from the account menu; you remain responsible for all activity on every account you own, and may unlink at any time in settings (unlinking does not delete either account).
- Preventing tier abuse. Attempts to create or link a third account, or a second account on the same tier, are blocked at verification or linking. Existing duplicates must be unlinked or closed.
- Anti-shilling. Linked accounts, accounts sharing an identity fingerprint, and any accounts operated by the same person, household or beneficial owner must not buy from one another, bid on one another's listings, message one another to simulate buyer interest, or leave feedback for one another. Any conduct artificially inflating prices, reputation, sales volume or feedback is shilling and will result in permanent termination of all accounts involved, removal of listings, cancellation of pending orders and withholding of outstanding payouts.
12. HMRC reporting and tax transparency
MintedUK complies with the HMRC reporting rules for digital platform operators in force from 1 January 2024, collecting certain seller information and reporting it to HMRC annually where required.
- Information we collect. Full name, address, date of birth and, for UK individuals, National Insurance number; for business sellers, legal business name, main business address, company registration number (or partnership UTR) and unique taxpayer reference. These are used for identity verification and tax reporting only.
- Aggregation across linked accounts. Gross sales and completed transaction counts are aggregated across all accounts sharing an identity fingerprint, so reporting cannot be avoided by splitting activity.
- When and how we report. We must report a seller's details and gross income where, in a calendar year, they make 30 or more sales of goods or their sales exceed the HMRC threshold (approximately €2,000 in local currency). Data is collected per calendar year and reported by the following 31 January. You will be able to view a draft in your dashboard, and any dispute about its accuracy must be raised through the in-app process by 15 January; later disputes must be corrected directly with HMRC after submission.
- Reporting is not a tax bill, and is not self-employment registration. Whether you must register depends on whether you are trading, your personal allowance and the £1,000 trading allowance. You can pass the £1,000 allowance before we report on you, or be reported on while under it. Casual sellers of personal preloved items are unlikely to be trading; Pro and Artisan sellers who buy or make goods to sell at a profit are more likely to need to declare income.
- Compliance freezes. We may withhold payouts, restrict listings or suspend new sales where a seller refuses or repeatedly fails to provide the NI number, UTR or other information required by HMRC. Withheld funds are released once the information is provided and verified.
- Accurate details. Keep your address, NI number, UTR and business information up to date so the report we send is accurate.
MintedUK does not provide tax advice. You are solely responsible for your own tax calculations, record keeping and submissions. Nothing on the platform is legal, financial or tax advice.
Official guidance: GOV.UK: Selling goods or services on a digital platform.
13. Chat safety, monitoring and reporting
All buyer-seller conversations happen inside MintedUK. Do not move conversations off-platform and do not exchange contact details, payment instructions or external links in chat.
- Monitoring under UK GDPR. We monitor chat to enforce these Terms, prevent fraud, protect vulnerable users and comply with legal obligations. Automated scanning may flag off-platform contact details, suspicious URLs, prohibited-item keywords, harassment or other breaches, and human moderators may review flagged messages. Monitoring is carried out as a legitimate interest, limited to what is necessary, and subject to our Privacy Policy. Flagged messages can lead to warnings, restrictions or suspension.
- Online Safety Act 2023. We operate protocols designed to comply with the Act, including risk assessment of user-to-user messaging and systems for reporting and acting on illegal and harmful content. Illegal content, child sexual abuse material, fraud facilitation, terrorism advocacy and serious threats of violence are not tolerated and may be escalated to law enforcement or the regulator.
- Platform liability for chat. Chat is a neutral communication tool. We are not a party to user conversations and accept no liability for message content, the accuracy of user statements, or any loss or dispute arising from private chat. You are solely responsible for what you send.
- Rate limits, blocking and reporting. Chat is limited to 10 messages per 30 seconds and 60 per 10 minutes; circumventing this is a breach. You may block any user (hiding their threads and preventing new ones, reversible in Dashboard → Privacy & safety) and report any user or message. Reports are reviewed by moderation; malicious or repeatedly false reports are themselves a breach.
- No harassment. Threats, hate speech, discrimination, sexual harassment and doxxing are prohibited and may result in immediate termination and referral to law enforcement.
- Notifications and service email. We send in-app notifications and transactional email about orders, deadlines, offers, messages, moderation outcomes, payouts and changes to these Terms. These are service communications and cannot be switched off while your account is open. Marketing email is separate and always opt-in.
13a. Stripe seller onboarding, payouts and reserves
MintedUK uses Stripe Connect to pay sellers. Onboarding is completed by you on Stripe's secure site (identity, UK bank account and ID verification, as required by Know Your Customer rules); we never see or store your bank details or ID documents. Listings go live once Stripe marks your account charges_enabled and payouts_enabled. Step-by-step guidance and answers to common onboarding questions are in our Help centre.
- Commercial agent status. MintedUK acts as a commercial agent authorised to negotiate and arrange sales. We take no title to goods, do not receive buyer funds on our own account, and are not a payment service provider, intermediary, e-money issuer or deposit-taker. Stripe remains the sole payment service provider.
- When you get paid. Casual and Artisan sellers are paid on a rolling schedule, typically 2–7 days after delivery is confirmed. Pro sellers may request faster schedules once trading history is established.
- Fees — all-inclusive. The MintedUK tier fee is the only deduction from your sale and already covers Stripe's UK card processing (1.5% + 20p domestic), which MintedUK absorbs from its platform fee. Every deduction is itemised on your payout receipt.
- Reserves and schedule changes. MintedUK and Stripe may each adjust your payout schedule, delay a payout or hold a rolling reserve based on account history, dispute rate, chargeback exposure, refund pattern, verification status or other risk indicators. Reserves are released as your risk profile improves.
- Refunds, disputes and clawbacks. Refunds and chargebacks are recovered from your balance under Sections 9 and 10, and you will be notified and given a chance to respond. You authorise MintedUK and Stripe to recover any negative balance, chargeback, network or dispute fee, refund or other loss by debiting the linked bank account and/or offsetting against future sales, payouts or reserves. This right survives account closure to the extent permitted by law.
- HMRC alignment. Stripe reports UK earnings under the same rules described in Section 12; keep your tax details current.
By onboarding with Stripe you also agree to the Stripe Connected Account Agreement. MintedUK cannot override Stripe's KYC or payout decisions.
14. Liability and financial caps
MintedUK is a facilitator and is not a party to the sale contract. Except where mandatory UK law requires otherwise, MintedUK is not liable for defects in listed items, product-safety incidents or regulatory breaches by sellers, and sellers indemnify MintedUK against any claim arising from their listings.
Financial liability cap. To the fullest extent permitted by law, MintedUK's total aggregate liability to any user for any claim arising out of these Terms or use of the Platform is limited to the greater of (a) the total platform fees paid by that user in the 12 months preceding the event giving rise to the claim, or (b) £100. This applies regardless of the legal theory asserted and even if we were advised of the possibility of the loss. Nothing excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
15. Changes, governing law and general provisions
We may update these Terms as UK consumer law and platform practice evolve; material changes are surfaced in your dashboard. For business users (Pro and Artisan sellers), material changes affecting the commercial relationship are notified at least 15 days in advance, except where an urgent change is required by law, regulation, court order or immediate risk to the Platform or its users.
- Governing law and jurisdiction. These Terms and any dispute arising from them are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, without limiting statutory rights to bring proceedings in the courts of your own country.
- Severability. Any provision found invalid or unenforceable is severed, the remainder continues in force, and where possible the provision is replaced by a valid one closest to the original intent.
- Force majeure. We are not liable for failure or delay caused by events beyond our reasonable control, including internet outages, third-party payment or carrier failures, strikes, fires, floods, pandemics, war, terrorism or government action.
- Entire agreement. These Terms, with the policies referenced in them, are the entire agreement between you and MintedUK and supersede prior agreements, representations or understandings.
- Assignment and waiver. You may not assign your rights or obligations without our written consent; we may assign ours to a successor on a merger, acquisition, restructure or sale of assets. A failure to enforce a provision is not a waiver, and a waiver is effective only in writing from an authorised representative.
- Third-party rights. Except as expressly provided, these Terms create no rights enforceable by a third party under the Contracts (Rights of Third Parties) Act 1999.
- Documents forming part of these Terms. Our privacy & data processing policy, cookie policy, importer policy and prohibited items list are incorporated by reference.
16. AI-assisted features
- Listing autofill and suggestions. Suggested categories, colours, brands, tags and keywords are generated from your photos and title. Every suggestion is editable and nothing is applied without your acceptance; you remain solely responsible for the published listing.
- Image and text screening. Photos and listing text may be screened automatically for prohibited or counterfeit goods. Outcomes are handled under Section 3, including your right to appeal.
- MintedBot support chat. Our assistant answers questions about how MintedUK works and can read limited details of your own account. It can be wrong or out of date, does not give legal, tax or financial advice, and cannot vary these Terms or authorise refunds, payouts or policy exceptions. Where its answer conflicts with these Terms, these Terms prevail; you can always request a human.
- No legal effect without human review. No decision producing a legal or similarly significant effect on you is taken by automated means alone.
17. Promotional boosts, badges and achievements
- Boosts. A paid boost increases visibility for a limited period only and is not a guarantee of views, offers or sales. Boost fees are non-refundable once started, except where the listing could not be shown due to a fault on our side or where a refund is required by law. If a boosted listing is removed for breaching these Terms, the remaining period is forfeited.
